Ranking member warns VA guardianship initiative could 'weaponize' probate courts

Ranking Member Ramirez used her opening remarks to raise sharp objections to the VA’s recent memorandum of understanding related to guardianship, calling the effort part of a Project Safe Harbor strategy she said could be used to place homeless and at‑risk veterans under court‑appointed guardianship.

Ramirez described whistleblower documents and criticized the MOU signed with Pam Bondi and the Department of Justice, warning that “weaponizing guardianship and institutionalizing veterans will do nothing to address the root causes of homelessness.” She framed the concern as a civil‑liberties issue and pledged extensive oversight.

VA witnesses acknowledged the MOU and said the department had requested feedback on related proposals. When questioned later in the hearing about whether the VA had provided written assurances that veterans would not be rounded up into guardianship, VA officials said they were working with the Department of Justice and that implementation guidance was under review.

Several members—including Ranking member Tano and others who later asked questions—pressed the department for written confirmation and additional transparency. The exchange highlighted a key oversight tension: members want explicit written limitations and an assurance of constrained use; VA officials said the department was still evaluating authority, applicability and legal guidance.
