Board approves boathouse height variance with condition barring habitable space

The board approved a variance allowing reconstruction and a second‑story addition to an existing boathouse on Bay Lake, but amended conditions to prohibit habitable space on the upper level and to require standard erosion, stormwater and permitting controls. Agent Steven DeMars said the plan moves the boathouse landward and "it's not gonna be a living living space. It's just basically 1 room," describing the proposed upper level as a screened seasonal porch rather than a bedroom or kitchen. The DNR had recommended against the variance, warning of shoreline visual impacts and concern about converting water‑oriented accessory structures to habitable uses.

Bay Lake Township and a township supervisor who testified supported the proposal, saying the rebuilt structure would be comparable to others on the shoreline and that moving it back from the water could improve shoreline protection. The board modified Condition 5 to require the second level be non‑habitable (no beds or kitchens) and approved the variance with the amended conditions; the applicant must obtain permits and produce as‑built surveys prior to completion.
