Code enforcement to fine property if storage pod not removed from Bishop's Gate Circle

Stow City code enforcement officials warned that weekly fines will start if a temporary storage pod at a home on Bishop's Gate Circle is not removed by the pod company as scheduled.

The Chair of the hearing placed case V-261134045 on the record and said the property owners are Clifford and Jennifer Bailey. Staff described a complaint received June 2, an inspection that day, a follow-up on July 14 that found the unit still in the driveway, a compliance date set for July 29, another inspection on Aug. 21, and referral of the matter to the law department on Aug. 26.

The Chair noted the applicable code — cited in the hearing as "11 0 4 0 8" — permits temporary storage on residential property without a permit for up to 15 days. "If it's not picked up by Wednesday and we haven't received word from pod company that there is a reason for that from their end, we'll begin to fine on Friday and continuously fine every week until the pod is removed," the Chair said.

A planning staff member said department staff had been in contact with the owner and had granted extensions after the owner asked for more time. "We have been more than willing to work with her because she needed more time," the staff member said, but staff reported the owner repeatedly postponed removal.

Meeting participants said the pod company told staff that pickup attempts had been canceled several times but that the company planned to pick up the unit on the scheduled date. When asked to confirm the removal date, the Chair confirmed "Wednesday, September 23." The Chair said fines would begin the Friday immediately after that date if the pod remained and no explanation from the company had been received.

The hearing record was closed after staff indicated there was nothing further to add. The enforcement directive is procedural rather than a court judgment; further legal steps could follow if compliance is not achieved and fines are not paid.
