In a recent government meeting, Brian Spear, manager of the Solid Waste Section at the Division of Waste Management and Radiation Control, provided an update on new solid waste rules and a temporary permit program aimed at facilitating regulatory transitions for waste facilities in Utah.
Spear announced the creation of two significant rules over the past three years, specifically Rule R315321 for landfill facilities managing E&P waste and Rule R315322, which addresses liquid waste management across various industries, including oil and gas. Both rules were published on October 15, 2024.
The temporary permit program is designed to bridge the gap as existing regulations are phased out. Public comments on the temporary permits are expected to be solicited in early December, with the permits anticipated to be issued by late January. These permits will be valid for one year, during which operators must transition their financial assurance from existing regulations to the new framework.
Spear emphasized the importance of financial assurance, noting that many waste operators currently use certificates of deposit as their primary financial instrument. The temporary permits will allow these instruments during the transition period, but operators will need to explore various financial assurance options available under the new rules.
Operators are required to submit a land farm transition plan within 90 days of the permit's issuance, detailing any changes to waste management site configurations. Additionally, they must maintain daily operating records and submit quarterly and annual reports on waste received and financial assurance updates.
The meeting concluded with Spear providing copies of the typical temporary permit for attendees, ensuring that operators understand the compliance requirements as they adapt to the new regulations.
