In a recent government meeting, the Division of Waste Management provided an update on new solid waste rules and the introduction of a temporary permit program aimed at facilitating the transition for waste facilities in Utah. Brian Spear, manager of the solid waste section, outlined the development of two significant rules over the past three years, specifically targeting landfill facilities managing exploration and production (E&P) waste.
The newly established rules, published on October 15, 2024, will convert existing land farms into landfills and address the management of liquid wastes across various industries. Spear emphasized the importance of these regulations for both the oil and gas sector and other industries dealing with liquid waste.
A key component of the meeting was the announcement of a temporary permit program, which is set to open for public comment in early December. This program is designed to bridge the gap as operators transition to the new regulatory framework. Temporary permits will be valid for one year, during which operators must submit a land farm transition plan and ensure financial assurance is transferred from existing regulations to the new framework.
Spear highlighted that approximately half of the waste operators currently utilize certificates of deposit as their primary financial assurance instrument, which will be accepted during the temporary permit period. Operators will also need to maintain detailed daily records of operations, including waste volumes and types, and submit quarterly and annual reports.
The meeting concluded with an invitation for public and agency collaboration, allowing stakeholders to voice any additional concerns or insights regarding the new regulations. The Division of Waste Management aims to ensure a smooth transition for operators while maintaining compliance with environmental standards.
