Desmond McGill from the community development department presented the application, explaining that the existing 10-foot-wide easement had been encroached upon during the construction of a single-family home in 2001.
The applicant has collaborated with the neighboring property owner to establish a new utility easement that will increase the easement width on the adjacent property. This adjustment aims to rectify the encroachment issue and ensure that the utility easement remains functional. The proposed vacation of the existing easement, which measures 85 feet in length and varies in width, has been deemed unnecessary for public use by the review team.
Council members raised questions regarding the nature of the encroachment, with some speculating that it may have resulted from a surveying error or construction oversight. Mayor Norton inquired about measures to prevent similar issues in the future, emphasizing the importance of addressing such errors proactively.
