The issue arose when a constituent, Johnny Anderson, received a notice from West Valley City regarding a business license for his home, which he was not renting but allowing his adult son to live in while attending college.
Anderson explained that despite clarifying his situation to the city, he was informed that since he did not reside in the home, it was classified as a rental, necessitating the payment of a business license fee. This prompted him to reach out to Senator Kwan, who agreed that the current regulations were unfair and initiated the bill to provide clarity and relief for similar situations.
Senator Kwan noted that the bill does not affect property taxes, which homeowners will continue to pay in full. The proposed legislation aims to standardize the approach across municipalities, as currently, practices vary widely—approximately half of the cities require such licenses, while others do not.
