The violation, categorized under section 24-19, subsections 11(a) and (b)(1-2), pertains to landscaping requirements for properties under three acres. Evidence, including photographs and a formal notice, was presented to substantiate the claim of a nuisance condition on the property.
The city determined that the existing conditions pose a threat to public health, safety, and welfare. Consequently, the nuisance will be managed through the city's nuisance abatement program. The property owner has been given until September 4, 2024, to rectify the situation by cutting grass and weeds, trimming trees and shrubs, and removing all trash and debris.
Failure to comply by the deadline will result in a daily fine of $100 until the violation is resolved. Additionally, the city will take necessary actions to abate the nuisance, with costs incurred being assessed against the property. The property owner retains a 30-day right to appeal the decision.
