In a recent government meeting, the Board of Zoning Adjustments (ZBA) addressed a request for a variance concerning a property located at 7698 South Country Club Road. The property, situated in single member district number 1, represented by Tommy Hebert, sought approval for a variance from the required lot width of 150 feet to a proposed width of 100 feet.
Ray Lineberry, a city planner, presented the case, noting that the lot's narrowness was not a result of the applicant's actions but rather its existing dimensions prior to being legally platted. The staff recommended approval of the variance, stating that it would align with the development patterns in the area and would not adversely affect neighboring properties. Out of nine notices mailed to nearby residents, only one was in favor, with no opposition recorded.
During the discussion, board members expressed some confusion regarding the variance process and the criteria for approval. Deputy City Attorney Brandon Dyson clarified that variances are site-specific approvals that allow deviations from the city's zoning ordinance, emphasizing that they cannot be used to change the permitted uses within a zoning district.
The board ultimately voted in favor of granting the variance, with no opposition noted during the public comment period. The motion passed, allowing the property owner to proceed with their plans to build on the lot, which is also noted to have a well.
The meeting also included a review of the zoning ordinance requirements for granting variances, highlighting the challenges faced by the board in interpreting these regulations. The discussion underscored the importance of adhering to established zoning laws while also considering the unique circumstances of individual properties.
