County Attorney Jeff Newton explained that the lawsuit's main contention revolves around the notification requirements for ordinances that lead to referendums. He noted that one of the exceptions to these requirements has been amended by the legislature and will take effect on October 1, leaving only one applicable exception. To mitigate the lawsuit's impact, the board voted to reintroduce the charter amendments as resolutions, which would effectively moot the legal challenge.
The board first approved a resolution concerning the rural boundary, followed by a second resolution related to municipal annexations. Both resolutions were passed unanimously, demonstrating the board's commitment to moving forward despite the ongoing litigation.
The meeting concluded with the board planning to reconvene later in the day for further discussions on planning and zoning recommendations.
