The Snyderville Basin Planning Commission convened on October 10, 2023, to discuss several key agenda items, primarily focusing on a proposed amendment to a plat note concerning access on Red Pine Road, which has raised significant concerns among local residents.
The meeting began with a representative from the Timbers Homeowners Association (HOA) presenting their opposition to the amendment. The representative emphasized that the amendment would remove existing restrictions on access from Red Pine Road, a matter of great concern for the residents due to safety issues related to increased traffic. The HOA highlighted that Red Pine Road serves not only as a thoroughfare but also as a recreational space for families and children in the community.
The representative argued that the proposed changes would lead to material harm to the residents, contradicting the planning commission's standards for approving such amendments. They referenced a previous plat amendment from 2012, which included a note aimed at protecting the health and safety of the community by limiting traffic on Red Pine Road. The HOA contended that the reasons for the original restrictions remain valid today.
Additionally, the representative pointed out that the county has no legal obligation to remove the plat note, asserting that the property owner had previously consented to the restrictions when the plat was approved. They argued that the current property owner, who purchased the land in 2019, should have been aware of these restrictions and cannot claim a taking of property rights due to the existing plat note.
Following this, another participant, Paul Malig, joined the discussion remotely. He expressed support for the HOA's position while also challenging some points made by the applicant's attorney regarding the landlocked status of the property. Malig noted that the proposed connection to the Hyatt Centric through an underground passageway contradicts claims of being landlocked.
The meeting concluded with a call for further public input, particularly regarding the site plan proposal, which will be addressed in a future hearing. The commission is expected to consider the concerns raised by the Timbers HOA and other community members as they deliberate on the proposed plat amendment and its implications for local traffic and safety.
