Ashley, Development Services staff, said the change would revert the requirement to the pre-2021 standard after the 2021 code adoption increased the setback from 20 to 30 feet. Staff said it is unclear whether the 2021 change was intentional or an error, and that the larger setback had forced staff to seek variances for several plats created under the earlier rule.

“At the request of the development community, staff researched this inconsistency and at the January 7 council meeting we received direction to bring back a city-initiated text amendment to revert this setback from 30 to 20 feet,” Ashley said. Staff recommended the Planning and Zoning Commission forward the amendment to the City Council for approval.

Commissioners questioned vehicle and trailer lengths and whether a 20-foot setback provides adequate space for common pickup trucks and travel trailers. Commissioner McCoy said a 20-foot driveway may not leave room between a vehicle and the street; other commissioners noted developers could choose to set homes back farther than the minimum on new plats. City Attorney Carl explained that zoning is not intended to regulate vehicle size and that encroachment into sidewalks or streets would be a violation.

One member of the public, Neil McDonald, urged larger lots and wider setbacks to accommodate vehicles and pools. Jason, Development Services staff, noted the amendment affects existing preliminary plats and that returning to 20 feet avoids creating many nonconforming lots that would otherwise need variances.

Staff recommended approval with five conditions, including a restriction that prevents placement of manufactured homes on lots less than 100 feet in length. Jason, Development Services staff, told the commission the site is zoned both R-16 and RMH-6 and that the proposed plat was designed with those designations in mind.

The condition on manufactured homes “states that no manufactured homes would be allowed on lots that are less than a hundred feet in length,” Jason said, noting that only four lots would be long enough under current lot dimensions to allow manufactured homes under the RMH-6 rules. Jet, the project engineer on the phone, said the developer does not plan to place manufactured homes and that most lots are about 97.5 feet deep, which would leave only a handful technically eligible under the zoning absent the condition.

The preliminary plat covers 19.13 acres north of Hualapai Mountain Road and west of Central Street (APN 321111115). Staff reported the site was annexed into the city in 1982 by ordinance No. 443 and partially rezoned in February 2006; current zoning maps show both R-16 and RMH-6 on portions of the property. The general plan designates the site as medium-density residential; the proposed layout yields about 4.6 dwelling units per acre.

Neighbors who spoke at the public hearing raised traffic, school safety, infrastructure, lot sizes, property values and possible parking/driveway impacts. Donna Robles said she and her husband were told the neighborhood would remain acre lots and that more houses would strain roads and services. Lisa Picard said Wallapai Elementary’s pickup and drop-off already causes congestion and asked how the project would address those safety concerns.

Developers and their representatives, including Annette Johansson of CAG 4 LLC and Doug Litt of DTL Homes, said their company intends to build site-built single-family houses, not manufactured homes. Johansson said the team has built about 200 homes in Kingman and “we have no intention of putting mobile homes there.” Jet reiterated that the RMH-6 portion mostly contains proposed retention basins and that, as designed, the subdivision would not practically support a manufactured-home park under the current preliminary plat.

City staff also said the developer will be required to improve Karen Avenue between Central and Indigo to full street width, including curb, gutter and sidewalk, and to dedicate five parcels to the city for drainage (including a roughly one-acre retention basin) that the city will maintain under current practices. Staff noted that any future change to allow manufactured homes on the site would require a replat and a new public hearing.
