The resolution also codifies confidentiality rules for panel members and staff while specifying narrow circumstances in which information may be disclosed: by court order to a court of competent jurisdiction; to a state or federal law enforcement agency provided the agency agrees to maintain confidentiality; or to members or staff of the House discrimination prevention panel or harassment prevention panel when necessary to inform an investigation and if confidentiality is maintained. The committee report states records produced under these rules would not be subject to the Vermont Public Records Act.

Representative Bartholomew said the changes align House rules with statutes that require the ethics panel to report a general description of complaint topics to the Vermont State Ethics Commission. He emphasized that HR6 applies only to the House Ethics Panel and not to the House Discrimination Prevention Panel or the House Harassment Prevention Panel.
