Elk Creek Fire Board faces appeal over consolidation without voter approval

First, he claimed that the Elk Creek board misapplied Colorado statutes, using a law meant for property exclusion rather than the required consolidation process, which mandates voter consent. Second, the resident accused the Elk Creek board of misleading citizens about potential tax reductions associated with the consolidation. He noted that the mill rate for North Fork was higher than that of Elk Creek at the time of the resolution's adoption, raising concerns that Elk Creek residents could face increased taxes without their consent.

Lastly, he criticized the board for failing to conduct a proper hearing as required by law, arguing that the meeting did not adequately address the necessary evaluation criteria regarding the impact of consolidation on Elk Creek property owners. He asserted that the board's lack of discussion on critical issues, such as service capabilities and economic implications, invalidated the resolution passed in November 2024.
