PERS officials gave figures to illustrate scale. Chief Administrative Analyst Teresa Chalmers said the system receives roughly $200 million to $300 million in contributions monthly; Lis said total delinquencies have ranged in recent periods from about $1 million in aggregate to lower figures. As of April 12, 2025 PERS reported two charter schools more than 90 days late with contributions, owing approximately $266,120 and currently on payment plans. PERS staff said nine employers had been delinquent in the prior two years and that charter schools were the employer type most frequently creating collection difficulty because they can cease operation.

Supporters included Brian Wallace of the Nevada State Education Association, who is also a vice chair of the PERS board, and Kent Ervin of the Nevada Faculty Alliance; both urged passage to protect employees' retirement records and accounts.

Committee members questioned whether the statute already provides for interest or penalties to make the system whole; PERS staff said penalties and interest are in statute and that the Retirement Board may waive penalties for good cause, but that collection options were limited when the Department of Taxation lacked jurisdiction over certain employer types. Retirees and active state employees provided detailed testimony. Patty Mockel, treasurer of AFSCME retirees chapter 4041, said she receives $221 per month for her Medicare supplement and that the HRA cap is unfair because it can cause unused funds to be swept by PEBB. \"If I choose to save the money for something catastrophic, why should PEBB be able to take these funds?\" she asked. AFSCME and allied unions argued the change is necessary to make up for lower wages and to keep experienced employees in state service.

Union and retiree witnesses offered concrete estimates and experience. Cassie Charles said the sponsors anticipate about 73 additional retirees becoming eligible for benefits in fiscal 2027, and roughly 100 per year thereafter. Supporters described health-care costs for certain retirees — including prescription and supplement expenses — that they said outpace the current HRA stipend, which they said has been increased only once since the post-2011 changes.

Opposition testimony focused on fiscal risk. Paul Merak of the Las Vegas Chamber said AB188 would reverse reforms adopted in 2011 and increase the program's unfunded liability. He cited a PEB fiscal note tied to a projected liability increase and an operational cost estimate; the chamber urged caution while the state's budget picture remains uncertain.

Committee members pressed witnesses on details. Tess Offerman, speaking for AFSCME retirees, clarified that the bill would restore pre-2011 coverage for actives so they could receive retiree coverage during the gap to Medicare eligibility; it would not move Medicare-eligible retirees off Medicare.
