Counsel and Laramie staff told commissioners the OGDP seeks establishment of an approximately 1,446‑acre OGDP and an associated drilling and spacing unit to develop two horizontal wells targeting the Mancos and Niobrara formations. The CCR pad will be developed on private surface with an executed surface‑use agreement and an approved Mesa County oil and gas site location permit. Laramie represented that federal mineral development is targeted from one of the proposed horizontal wells and that it has submitted the federal APD to the Bureau of Land Management; BLM indicated it was finishing NEPA and anticipated approval on or about June 2, 2025.

Laramie described multiple elements of its plan to avoid, minimize and mitigate impacts. The company said the CCR is near existing buried pipelines that will be used for production takeaway, reducing truck traffic, and that freshwater for preproduction will be supplied by temporary surface lines to limit truck trips. Laramie reported the following disturbance figures: 7.5 acres for the pad working area, 1.9 acres for the access road, 0.8 acres short‑term disturbance for buried pipeline and waterline, and 5.2 acres scheduled for reclamation, leaving a 2.3‑acre production pad surface; Laramie characterized 4.2 acres as long‑term disturbance of the total roughly 10.2 acres and said 42% of the project’s area would be long‑term disturbance.

The company conducted outreach to owners and tenants of residential buildings (RBUs) within 2,300 feet; two RBUs are within 2,000 feet and three more are between 2,001 and 2,300 feet. Laramie reported that all RBU owners and tenants within 2,300 feet signed informed consent. Laramie also consulted with Mesa County, the Bureau of Land Management, Colorado Parks and Wildlife, Colorado Department of Public Health and Environment, Ute Water Conservancy District and the towns of Colburn and Palisade (presented as Town of Colburn/Pohlbrin in the filing). Because the CCR is 14.79 stream miles downgradiant from a Ute Water Conservancy District public water intake, the project triggered ECMC Rule 304(c)(1) for an emergency spill response program. Laramie submitted an emergency spill response program plan consistent with ECMC Rule 411(a)(4), Rule 602(j) and Rule 912(b)(1); Ute Water asked to be notified of any spills and approved the plan on Sept. 10, 2024, according to Laramie’s presentation. Laramie also described an air monitoring plan that staff said will be submitted to CDPHE.

During deliberations commissioners praised the alternative location analysis and the extent of outreach. Counsel noted a typographical error on the Form 2A describing a drilling rig as “tier 5”; Laramie asked the commission to record that the correct reference is to a “flex 5” (and that the noise mitigation plan correctly referenced the lehi 5 rig). The motion that Commissioners approved included that correction. ECMC staff and applicants said they would continue to coordinate with BLM, CDPHE and other agencies for required permits and monitoring plans. Trask highlighted that the 2024 report was prepared entirely in-house for the first time and thanked internal staff and external partners for contributions: Colorado Department of Public Health and Environment staff contributed to air-quality chapters; Colorado Parks and Wildlife provided most of the wildlife chapter; and ECMC’s reclamation and GIS teams supplied analyses and visualizations. Trask said the exceedance was driven almost entirely by preproduction emissions associated with the drilling and completion of a single well last summer. “Their preproduction NOx emissions were 9.4 tons. 9.32 of those tons specifically were registered as from their tier 4 diesel or dual fuel engines that they used in completions,” Trask said. She added the operator’s reported production emissions were 0.048 tons and that the operator’s reported production volume was 186 (as reported in the interim submission).

The exceedance prompted staff follow-up with the operator and coordination with Colorado’s Air Pollution Control Division and the Air Quality Control Commission. Trask said the operator is not planning preproduction operations for 2025 and anticipates higher production this year because a new well came online late last year, a combination that staff expects will bring the operator into compliance with the NOx intensity calculation. “We intend to approve their Form 2D. We will, however, approve it with a condition of approval … in which the operator will not be allowed to conduct preproduction operations between May 1 and September 30 this summer,” Trask said.

Commissioner Oth, who asked questions during the update, praised staff follow-up and emphasized the separate roles of agencies in this situation. “If we were seeing that the pathway to compliance was just an increase in production, I think that would cause a lot of concern,” Oth said, noting that emissions enforcement is a matter for CDPHE/APCD, while ECMC’s jurisdiction covers operational approvals.

Trask also reminded commissioners that ECMC’s Rule 316(d) permits, but does not require, the director to apply additional measures to reduce NOx if operations contribute to noncompliance. APCD’s annual OnGare emissions inventory — due in June under the applicable reporting schedule — is the more complete dataset APCD will use to determine whether an operator faces enforcement actions.
