Puerto Rico lawmakers investigate telecom permit process in Dorado after court ruling

The Puerto Rico Legislature convened on June 25, 2025, to discuss significant developments regarding the construction of a telecommunications facility in the Mameyal neighborhood of Dorado. The meeting featured presentations from representatives of the Department of Economic Development and Commerce (DDEC) and the Planning Board, focusing on the ongoing investigation prompted by Resolution 178.

Miguel Mijayevich, an attorney from the DDEC, outlined the department's role in overseeing economic development policies and facilitating the permitting process. He explained that the investigation was initiated following a permit application submitted by IT Towers LLC in January 2022. This application sought approval for a telecommunications tower, which faced opposition from local stakeholders, including the municipality of Dorado.

The DDEC reported that the Office of Permits and Planning (OPE) initially approved the construction permit in September 2022. However, the municipality contested this decision, leading to a series of administrative and judicial reviews. Ultimately, the Appeals Court revoked the permit, citing a lack of necessary recommendations from the tourism agency, as the proposed site was deemed to be in a tourist interest zone.

In February 2025, a new application for the same project was submitted by Elite Colp Towers LLC, which included the required endorsements from the tourism agency. The OPE has since indicated that the application is under review, but additional documentation is still pending from the applicant.

José Airán Díaz, representing the Planning Board, emphasized the board's commitment to transparency and collaboration with the legislature. He acknowledged the legislative body's authority to investigate matters related to public interest and reiterated the Planning Board's role in ensuring compliance with permitting laws.

The meeting concluded with a call for further comments from the Planning Board to aid in the investigation, highlighting the ongoing complexities surrounding the permitting process for telecommunications infrastructure in Puerto Rico. The discussions underscored the balance between economic development and regulatory compliance, as stakeholders navigate the challenges of local opposition and legal requirements.
