City Council Approves Short Term Rental at 140 Avenida Del Reposo

The San Clemente Zoning Administrator Meeting on August 21, 2025, focused on a proposal for a short-term rental at 140 Avenida Del Reposo, a duplex situated in a residential medium zone and coastal overlay area. The property, which spans 5,139 square feet, is located outside the established Short-Term Lodging Unit (STLU) zone. However, it previously housed two vacation rentals at adjacent properties, 138 and 140 Avenida Del Reposo, prior to the establishment of current STLU operating licenses.

The proposal seeks to permit a short-term rental for the upper unit at 140 Avenida Del Reposo, which features two bedrooms and one bathroom, accommodating a maximum of six guests. The location is conveniently near popular attractions such as the beach and local plazas, making it an appealing option for visitors.

City staff recommended the project be deemed categorically exempt from further environmental review and supported the adoption of resolution 25015, which would approve the short-term rental application. The meeting also addressed a minor error in the hearing notice, which inaccurately stated that there was a current STLU operating at the site, when in fact, there was only a previous vacation rental.

Principal Planner Zachary clarified that the conditions of approval would allow the new rental to operate as soon as May 17, 2026, or earlier if neighboring rentals ceased operations before that date. This flexibility aims to accommodate the applicants while ensuring compliance with local regulations.
