Broward County Magistrate Approves Removal of Hazardous Shared Oak Tree in Cooper City

Cooper City officials are taking decisive action regarding a hazardous tree that straddles the property line between two homes on Southwest 49th Court. During a recent special magistrate code enforcement meeting, city representatives presented evidence that the large live oak tree poses a significant safety risk due to its lean over the roadway and compromised root structure.

City Arborist Patricia Hoot testified that the tree, estimated to be around 80 years old, has been leaning for years and has been improperly pruned, exacerbating its unstable condition. Hoot's report indicated that the tree's roots are lifting, creating a dangerous situation for nearby residents and vehicles. The city is seeking permission to remove the tree, with costs to be shared equally between the two property owners involved.

Both homeowners expressed agreement on the necessity of the tree's removal but are currently in dispute over who should bear the financial responsibility for the work. The magistrate emphasized that while the city can facilitate the removal, the financial arrangements are a matter for the homeowners to resolve independently.

The magistrate ordered that the tree must be removed by September 13, 2025, or the city will proceed with the removal and impose fines on the homeowners. The urgency of the situation highlights the city's commitment to public safety and the need for residents to address shared property issues collaboratively.

In addition to the tree matter, the meeting also addressed other code violations in the city, including excessive overgrowth and unpermitted structures, underscoring the ongoing efforts by Cooper City officials to maintain community standards and safety.
