Antar said the bureau has issued 1,531 total licenses since inception and, as of June 30, 2025, there were 866 active licenses, 17 inactive and 29 retired. The bureau received 99 initial applications to take the exam and issued 96 new licenses during the fiscal year. Processing times reported for the fourth quarter were 36 days to approve completed exam applications and 8 days to issue a license after passing the exam. Renewals numbered 791 for the year with an average fourth-quarter processing time of 26 days.

On enforcement, Antar reported the bureau received 174 complaints during the fiscal year, closed 101 complaints with an average of 149 days to close, and had 171 complaints pending at the end of the reporting period. The bureau issued 9 citations and referred 3 cases to the Attorney General’s office for possible disciplinary action.

During public comment, James Counts praised the increase in new licensees but said the bureau will need further growth in licensees — and possibly other revenue increases — to offset recent expenditure increases. Another public commenter, identifying as a newly licensed fiduciary, asked for more accessible, detailed licensing data so practitioners can refer clients to specialists within the profession.

AB 586 (Flora), as amended Aug. 18, 2025, would have allowed one or more licensed fiduciaries to organize a professional fiduciary professional corporation, required those corporations to register with the Secretary of State, and required individual fiduciaries who provided services for the corporation to be licensed. The bill would also have allowed the bureau to request nonpublic, corporation-wide reports with specified case information and to pursue disciplinary action against corporations or officers for specified violations. According to Alice, AB 586 was held on suspense in the Senate Appropriations Committee and is dead for the year.

AB 1105 (Corky Silva), as amended July 3, 2025, would have authorized a conservator to place a conservatee in residential facilities, intermediate care facilities, or nursing facilities that have secured perimeters or security features that lock after exits for a set period, and would have required the Department of Social Services and the Department of Public Health to update implementing regulations. Alice said AB 1105 was likewise held on suspense in the Senate Appropriations Committee and is dead for the year.

The advisory committee did not take a position on either bill at the meeting. Alice said she is available for questions and that the legislative calendar includes a Sept. 12 deadline for the Legislature to pass bills and Oct. 12 as the governor’s deadline to sign or veto legislation.

The fund condition statement Vu presented showed a beginning balance for 2024–25 of about $301,000, receipts of approximately $1,288,000 in the prior year (with about $223,000 from initial license fees, $1,000,000 from renewals and $65,000 from citations/fines), and $745,000 in expenditures that included $69,000 in statewide pro rata and pension payments. For the current projection Vu described, revenues for 2024–25 were forecast at just over $1.2 million (about $171,000 from initial license fees, $998,000 from renewals and $60,000 from citations and other receipts).

Vu told the committee the budget office applies a conservative 3% ongoing escalation to expenditures to account for personnel and retirement cost adjustments and cautioned that “any future legislation or unanticipated events could result in the bureau’s need for additional resources,” increasing cost pressure on the fund.

Why it matters: the bureau’s fund underwrites licensing, enforcement and other bureau functions; sustained negative cash flow could require fee adjustments, legislative remedies or reductions in services.

During public comment, James Counts, CPA, CTFA, reviewed the fund condition and told the committee his reading of the materials shows the bureau’s expenditures rising while revenues remain roughly flat. Counts said those trends, if sustained, “appear that roughly before the end of the calendar year 2030, the bureau will run out of funds.” He cited a projected 63% increase in expenditures in the most recent year and an 11% drop in revenue from the prior year in his remarks.

The committee did not take a formal fiscal action at the meeting. Angela Cuadra, program analyst for the bureau, recorded Counts’s request for the bureau to review negative cash flow and possible solutions as an item for future agenda consideration.

Other public commenters urged growth in the number of licensed fiduciaries to increase revenue over time and asked the bureau to provide more granular licensing data to help practitioners refer work within specialties.
