City attorney explained the city’s recent purchase of property behind Lowe’s included a retention pond the Fryman Trust intended to retain because Lowe’s still uses the pond. The city attorney described a proposed quitclaim deed that would convey the retention pond back to the Fryman Trust, saying the city never intended to acquire that pond.

A council member moved to approve the quitclaim deed and authorize the mayor to execute it; the motion was seconded and passed by roll call. Staff characterized the deed as correcting the property conveyance so the pond remains with the trust and continues to be used by Lowe’s.

Council offered no amendments and there was no public comment on the item.
