County Counsel Joe Larmer reported on the closed-session outcome, saying, “Item R4. The board voted 4 to 1 to authorize an appeal of the matter. R5 no reportable act.” The board then identified Supervisor Patrick Long as the lone dissenting vote.
By statute, the board is permitted to discuss pending litigation in closed session and report only limited outcomes. The board did not disclose the subject matter of the litigation during open session, and Larmer said the vote was the only reportable action.
Supervisor Long was recorded as the nay vote when the chair asked for identification of the vote split. The board did not provide additional public materials or a schedule for any filings related to the authorized appeal.
