Commission members discussed continuing problems at South Bridal Estates, where residents and the commission disagree about tree cutting within a resource area and the location and ownership of a detention/retention pond.
Commission members said they are working with Mark Stinson and have funds available to hire a wetland specialist to assess the alleged illegal cutting. One member reported that some recipients of an enforcement letter questioned whether the conservation commission has authority to flag wetlands on private property. The commission said the town authorized conservation-review activities and that such field flagging is standard practice for raw land reviews.
Gary Wiener, an original engineer for the subdivision, told commissioners by phone or in prior contact that the landowner, Russ Moritz, should pay to have the detention pond work corrected; commission members said Russ has been reluctant to cooperate. “Russ has dug his heels in, and I don't think he wants to do that,” a commission member said. The commission noted there is a right-of-way and some questions about which parcels own or maintain the detention area.
Commission members said they will continue to pursue resolution, coordinate with Mark Stinson, and, if necessary, hire a consultant to delineate resource areas and recommend corrective measures. No formal enforcement vote was recorded at the meeting; members described the matter as ongoing.
