Nye County commissioners approved a request from Beatty Disposal on Oct. 7 to waive the contract’s usual 3.5% cap on consumer price index adjustments and to allow a one‑time rate increase up to 7.63% starting Dec. 7, 2025. The motion passed 4-1.
Public Works Director Tom Bowling explained the company followed the franchise contract procedure for a CPI overage request. “They have to request the increase for the overage from the Board,” Bowling told commissioners, explaining the filing and timing requirements in the franchise agreement.
The board considered the letter from Beatty Disposal, which asked for the higher adjustment to reflect higher operating costs. Commissioners approved the waiver and the adjustment with a single dissenting vote.
County staff will implement the new rate schedule beginning Dec. 7 and document the franchise accounting per the contract terms.
