Council introduces rent-control changes to require proof of prior rents and audits

The Hoboken City Council introduced and approved first reading of an ordinance that would require landlords to provide documentation of prior rent payments when registering or adjusting rents and authorize routine audits of a sample of registered units.

Advocates from Hoboken United Tenants urged the council to adopt the amendments, saying the changes close a long‑standing enforcement gap in the city’s rent‑control framework. Tenants and tenant‑advocacy groups told the council landlords sometimes report inaccurate rents on registration forms and that the rent‑control office generally has not required proof of prior payments.

Connor Shea, a lawyer who spoke on behalf of tenant organizers, said a law without an enforcement mechanism is ineffective: “A law without enforcement mechanism is really no law at all.” Members of Hoboken United Tenants said the ordinance’s audit provision — auditing a percentage of registered units annually — would create transparency and deter illegal increases.

Council members who supported the ordinance said the changes were targeted and would not immediately create sweeping new enforcement burdens; the sponsor amended the introduced text to add the word “rent receipts” into the notification section before the roll‑call.

The clerk recorded a roll‑call vote to introduce the ordinance; the motion passed and the item will return for a second reading and final adoption at a later council meeting. Supporters asked the administration to prepare guidance and to develop a process for annual audits and public reporting of audit results.
