Developers for Street Legal LLC appeared before the Planning Board Oct. 7 to request modifications to a master-plan decision and waivers of preliminary-plan checklist items. After staff and board discussion, the applicant withdrew the specific waiver requests for agenda items 5 and 6, saying the outstanding materials had been submitted or supplemented to planning staff, and the parties agreed to proceed toward certification once staff has compiled and reviewed resubmitted materials.
Dana Riley, counsel for Street Legal LLC, told the board the team provided additional documentation to planning staff following a technical-review committee (TRC) meeting earlier in the day. Riley said some items were withheld while the applicant sought written confirmations from town departments and third parties.
Planning staff explained the distinction between checklist items that are required for early certification versus items that statute allows to defer until final plan. Staff also told applicants that piecemeal resubmissions of deficient items force the planning office to restart statutory decision time clocks, which complicates review; staff asked applicants to package deficiency responses in single resubmissions when possible to avoid repeated resets.
The TRC met the same day to review standards and the staff will provide minutes. Applicants and staff agreed to package outstanding items for a single resubmission; the board directed staff to restart the certification process when a consolidated response is filed.
The board also voted to reschedule the board's regular November meeting from Nov. 4 (Election Day) to Thursday, Nov. 6, at 6:30 p.m., to ensure adequate notice and to provide time for staff to complete the certification process for pending preliminary-plan applications.
No substantive land-use approvals were granted for the Street Legal project at the Oct. 7 meeting; the discussion focused on process, checklist items, and timing. The board asked staff to circulate a clear procedure for packaged deficiency submissions so the certification clock is not inadvertently restarted by incremental filings.
