The Planning Commission unanimously approved Z-2025-17, a text amendment to Section 15.6 that changes how the city records Board of Zoning Appeals decisions and notifies property owners.
Planning Department staff told commissioners that the code previously required the Board of Zoning Appeals to “pass a resolution” after hearings. After consulting with Erica, the city clerk, staff concluded only the City Council has authority to pass such resolutions. The staff member said the revised language mirrors the City of Derby’s zoning regulations for the Board of Zoning Appeals: staff will write a letter noting approval or denial of a variance, send it to the property owner, and file letters for approvals with registered deeds so a title search will reveal approved variances.
The staff member clarified that denials would be mailed to property owners but would not be filed with registered deeds. Commissioners opened and closed the public hearing with no speakers and approved the amendment by voice vote.
The commission did not add further requirements in the text amendment. Staff also indicated an administrative change in noticing practice and said they would follow the updated process going forward.
