Commissioners approve easement to allow Dutch Bros. site; health department approved well plan

The St. Joseph County Board of Commissioners approved an isolation easement with Quattro Granger LLC that allows an encroachment into the Adams Road public right-of-way to accommodate a very small commercial parcel where a Dutch Bros. Coffee is proposed.
Bill Shalio, economic development director in the Department of Infrastructure Planning and Growth, said the site — east of the Walgreens at State Road 23 and Adams — is tiny and requires a waiver and easement because the well and septic for the proposed coffee shop would extend into the public right-of-way. Shalio said the existing ATM on the lot will be removed and Dutch Bros. is planning this as the county’s second location.
Shalio told the commission that the easement and related documents had been reviewed by multiple agencies; he said planning and the health department had reviewed the plan and approved it. Commissioners approved the easement with the provision that the specific well number be inserted into the final recorded document once it is assigned.
A commissioner asked whether the easement would limit future county work in the Adams Road right-of-way. Shalio said department staff believe there will be no limitation on repaving, utility extensions or other future right-of-way improvements; routine notice would likely be required before work but no permanent restriction was expected.
The commission moved and seconded approval; the record shows Commissioners Morton, Hazen and Backliner voting aye and the motion carried.
The easement allows the developer to proceed with required waivers and health approvals to build the site; the county stated it will include the well identification number in the recorded easement when that number is available.
