Cass County Commissioners adopted Ordinance 2025-12 on Oct. 6, 2025, amending the county's hazardous-material response fee schedule so the county can charge higher fees to parties responsible for spills and cleanups.
County staff said the change updates dollar amounts in a prior ordinance rather than altering descriptive language. "We're just swapping out dollar amounts, so we can collect a little bit more, which would be nice because nothing in the hazmat world's gotten cheaper," Rocky, a county staff member, said during the presentation.
The presentation said the amendment updates Ordinance 2022-18 (which previously amended an ordinance cited as 9803) to reflect fee adjustments the state fire marshal periodically sets. Commissioners discussed that the change ensures responsible parties, rather than Cass County taxpayers, cover costs for maintaining hazmat response teams and replacing used equipment.
There were no public comments on the item. A motion to amend Ordinance 2022-18 to Ordinance 2025-12 and to adopt Ordinance 2025-12 as presented carried on a voice vote with commissioners responding "Aye."
