The Kenosha County Planning, Development & Extension Committee approved a rezoning request and a certified survey map for a parcel in the Town of Wheatland, sending the matter to the County Board and, if approved there, to the County Executive for signature.
The approvals affect tax parcel number 9541190610441, described in committee materials as the property associated with Marilyn J. at 390 Sixth Avenue in Burlington (Town of Wheatland). The committee approved rezoning the portion containing the house from A-1 (agriculture preservation district) to R-2 (suburban single-family residential district) and approved a CSM to divide the existing parcel into two lots, subject to standard recording conditions and survey corrections.
The rezone request and the proposed CSM were presented by Andy Bealer, director of planning development, and by petitioner Wayne H. Cutts, who confirmed his ownership history and the property transfer language in a will that returns the land to him. "The only reason why we're here for this one is to rezone the house, which is now [on] an A-1 parcel. Now the house had to be rezoned R-2 residential," Cutts said. The committee materials show the requested rezoning aligns with the county comprehensive plan.
Committee staff displayed maps showing the portion to be rezoned and described the CSM as a land division that would create one lot on the west side of the property and one on the east. Bealer said the CSM includes a right-of-way dedication and that recording will follow the surveyor's corrections and chair signature. Warren Hansen of Pierce Hansen and Associates, the surveyor identified in the record, will receive the conditions and update the CSM for recording.
The Town of Wheatland considered the rezoning and CSM at its Sept. 22 meeting and voted to approve both items, according to committee minutes. The committee likewise moved the matters forward; staff told the petitioner he did not need to attend the County Board presentation, which will be handled by the committee chair or vice chair. If the County Board approves, the County Executive will sign the ordinance and the CSM will be recorded after required corrections are made and the $30 recording fee is paid.
Committee approval was recorded as passing; the motion and second were not named in the committee record. The approvals for the CSM were conditioned on corrections specified by planning staff being made prior to recording.
The items will appear on the County Board agenda next week; staff will notify the petitioner after recording is complete.
