At a Corporation Commission business meeting, commissioners approved an order directing that a homeowners association (HOA) complaint against KGS be served for an answer in docket 26KGSG100COM.
The complaint, filed on behalf of an HOA in Prairie Village, alleges that 22 ornamental gas lantern accounts were incorrectly classified as commercial and asks that the accounts be consolidated to reduce billing. Aaron Bailey, the presenter for the item, told the commission the HOA estimated consolidation would save about $12,000 annually. "They believe that they've been, classified as commercial in error, and they're asking to have these accounts, consolidated to save about $12,000 annually," Bailey said.
Bailey recommended the commission find the complaint meets the prima facie standard under KAR 82-1-220 and that the complaint be served on KGS for an answer. Commissioners asked no substantive questions before taking action. Commissioner Keane moved approval of the order; the motion received a second. The commission voted unanimously in favor and approved the order.
The order instructs staff to serve the complaint on KGS for a response under the cited regulation. No further factual findings or remedies were announced at the meeting; the action was limited to the commission's determination that the complaint should proceed.
