Peggy Walker of the San Diego Alliance for Drug-Free Youth urged the Encinitas Environmental Commission during oral communications to consider how Assembly Bill 455's disclosure requirements could inform future local policies for multiunit housing.
Walker told commissioners that AB 455, she said, was signed by the governor on Oct. 3 and requires sellers of single-family homes to disclose in writing whether smoking or vaping occurred on a property and directs the Department of Toxic Substances Control to update the homeowner's environmental-hazards guide to include information on thirdhand smoke. "AB 455 highlights the fact that secondhand and thirdhand smoke are serious health hazards, especially for children and especially toddlers and crawling babies who touch all those surfaces," Walker said.
Walker said the City of Encinitas has discussed smoke-free multiunit housing ordinances and suggested the commission consider whether similar disclosure requirements should apply to multiunit rental housing, where tenants may be exposed to residual smoke contamination. She provided commissioners a written summary of AB 455 and suggested staff consider incorporating the concept into future tobacco-related outreach or regulatory projects.
No action was taken; the comment was entered into the meeting record during the public-comment period.
