Trustee raises liquor-license wording concern; board approves consent agenda 7-0

Trustee Richard Neto told the Suamico Village Board on June 16 that language in the draft minutes for June 2 changed the description of a temporary Class B (beer) license area from "enclosed" to "open air," and he wanted clarification before approving the consent agenda.

Neto said he contacted the state Division of Alcohol Beverages (within the Wisconsin Department of Revenue) and was told the village board cannot override a liquor license premise; he relayed that as a reason for concern. He also spoke with the village attorney, who advised the board that approval of a license is within the board's authority but changing the licensed premises could create an issue.

Zoning Administrator Dunks told trustees that, in this case, "enclosure" had been used broadly to mean any type of containment (including rope or bicycle fencing) to show where alcohol consumption is allowed. Trustee Eckert and others said their practical reading of "enclosure" when the license was discussed at the June 2 meeting had been to include temporary fencing or rope rather than a permanent structure at the site, which is an open-air facility adjacent to the establishment.

Trustees discussed whether approving minutes could itself create liability; staff explained that approving minutes records what occurred but does not change the underlying license; formal action to alter a licensed premises would be a separate matter. After discussion Trustee Richard Neto moved to approve the consent agenda; Trustee Romas seconded the motion. Trustees voted in favor, and the motion carried 7-0.

The consent agenda included prior meeting minutes, several monthly reports, the treasurer's report and a temporary-class B beer license request for Howard Suamico Youth Sports Association for July 2025 at Calavera Springs Park and Idlewild Park.
