The Sayreville Board of Education voted Sept. 24 to enter an executive session to discuss personnel issues, student matters and attorney‑client privileged topics under the Open Public Meetings Act, Chapter 231, P.L. 1975.
Board members first moved and seconded the request to close the public meeting and the board adopted a written resolution stating that “the public shall be excluded from discussion of and action upon the here and after specified subject matters.” The resolution said the subjects to be discussed included personnel, student matters and matters falling under attorney‑client privilege and that the matters will be made public when nondisclosure is no longer required.
At the opening of the meeting, the presiding official said the public meeting notice for the Sept. 24 meeting had been sent to the Home News Tribune and the Star‑Ledger, filed with the borough clerk and posted on the bulletin board outside the board secretary’s office. The board then called the roll, asked for a motion to move into executive session, and approved the resolution. Those who explicitly recorded a “yes” vote on the resolution in the transcript were Board member Fernandez; Board member Paulitano; Board member Pabone; Board member Pylock; and Board member Bloom. The motion and second were not attributed to specific members in the public record.
The resolution states it “shall take effect immediately,” and the board recessed to executive session. No substantive details of the personnel, student or attorney‑client matters were disclosed in the public portion of the meeting.
The board’s action closed discussion of the listed items to public observation as permitted by state law; the transcript shows the vote and the subjects identified in the resolution but does not record any public deliberation about the contents of those matters. Any reports or actions arising from the executive session will be disclosed only if and when the board determines that nondisclosure is no longer required.
