Urbana to repay federal/state funds for Windsor Road defects; council moves funding amendment

Tim Cowan, city staff, briefed council members that litigation with the original contractor addressed some liabilities but FHWA and IDOT determined the city must repay a portion of federal dollars tied to construction that failed to meet standards. Cowan said the federal request totals approximately $537,512 (figure stated in the meeting packet) and that until the repayment is made IDOT is withholding authorizations for certain state motor fuel tax expenditures and change orders.
Why this matters: Repayment must be addressed for the city to receive state authorization for additional motor‑fuel tax expenditures and to proceed with change orders and projects in the FY2025 capital plan. Cowan said the city previously used internal short‑term measures (a bridge loan among funds) to keep work moving but needed council action to include the repayment in the revised budget so IDOT would lift the hold.
Council action: Council accepted a friendly amendment to include a revised Exhibit A with the federal repayment amount in budget amendment number 4; the ordinance passed on a roll call vote with all members voting yes. Staff said a follow‑up review of the capital improvement program will determine which Windsor Road maintenance projects are deferred or adjusted because of the repayment obligation.
Next steps: Staff will reconcile the CIP schedule with the repayment and report to council which scheduled maintenance activities will be delayed or altered as a result of the repayment and the IDOT authorization status.
