Commission agrees alternates may fill in as voting members when activated; rotation rule adopted

The Fort Myers Beach Charter Review Commission on Oct. 7 agreed that its two alternates should be invited to attend meetings, participate in discussion and, when activated to replace an absent commissioner, exercise full voting rights for that meeting.

Town Attorney Nancy Stuprich told the commission the current town charter does not specify how alternates should be used; the group discussed whether alternates should simply advise or formally substitute for absent members. Commissioners agreed that an alternate stepping in for a missing commissioner should count toward the commission’s three-member physical quorum and be able to vote during that meeting.

The commission also adopted a practical rule for the scenario when both alternates are present and one must be activated: alternates will rotate activation based on who last filled in. Commissioners discussed that alternates should attend regularly when possible so they are up to date on prior discussion and better able to serve if called on.

Commissioners acknowledged the charter contains no alternate-specific language and instructed staff to check with the town council about whether a council resolution or ordinance is needed to formalize alternate authority. Stuprich said council-level action (for example, a resolution or temporary ordinance) might be used to clarify alternates’ authority if the commission wants a more durable rule.

The commission voted unanimously to codify the alternates’ role in its rules of operation, with staff tasked to seek any required council authorization to finalize that policy.
