John Lovely, the developer who filed the petition, told the committee the vacation request covers "0.05 acres, on the East side of the Emerson Forest Parkway that's within the original Woodhaven development." He said the recorded half‑street stub was a dead‑end and that removing the recorded right‑of‑way would allow two existing lots to be replatted into five.
Committee members confirmed the Department of Public Works had recommended conditions typical for this type of action — removal of any existing approach, replacement of curb, and establishment of a tree lawn to city standards — and the developer agreed to those requirements. Citizen member Carl Latrell asked about a Snuff Street approach; Lovely said he did not find a clearly defined approach in the field or survey but agreed any small approach found would be removed and the stub extended to serve a driveway where appropriate.
No members of the public spoke for or against the bill. Following the presentation and public hearing, a motion to forward Bill 50‑25 to the committee of the whole with a favorable recommendation carried on a roll call: Council member Warner, Dr. Davis, citizen member Carl Latrell, Committee Vice Chair Goodman Rogers, and Committee Chair Neskovsky recorded ayes.
The committee's favorable recommendation carries the item to the committee of the whole for final consideration and any additional conditions required by the body.
