The agreement provides financial assurance for public utilities serving ZenWay; the developer will keep ownership and maintenance responsibility for the road surface. Village staff will accept and maintain the utilities once constructed and dedicated, but the roadway itself will remain privately maintained.
Administrator Caker introduced the item, saying, “the road will remain private, but the other infrastructure will be dedicated to the public.” Board members asked how a private road would affect long‑term maintenance and standards. Zoning Administrator Dunks confirmed the village participated in the design of water and sewer lines and that those utilities will be dedicated to the village. Dunks said stormwater work for the site largely ties into previously constructed Chambers Hill storm systems, with some storm sewer placed under the road and connected to existing infrastructure.
Trustees noted examples of prior subdivisions with private roads, including Hickory Meadows and Wisteria Circle, and discussed the possibility that nonstandard roadway construction could lead to future requests for village assistance. Administrator Caker and Dunks said the village will provide staking and inspection for utilities so those elements meet village standards before acceptance.
Trustee Romas made the motion to approve the agreement; Trustee Neto seconded. The board voted unanimously, 6–0, to approve the development agreement.
The agreement means the village will own and maintain water and sewer mains and storm infrastructure built to village‑accepted specifications, while the developer or homeowners’ association will be responsible for the roadway surface and its upkeep. If future requests come to the village to upgrade or accept the road surface, those would require a separate action by the board.
