Columbia Borough Council approved release of a letter of credit for the 315 Locust Street project on Aug. 12, contingent upon receipt of proof that an off‑site parking lease agreement has been recorded.
Staff explained the history: when the 315 Locust Street project received zoning approval, a condition required the developer to secure additional off‑site parking spaces and tie them to the property so they remain with the development if property ownership changes. Staff said the developer provided an executed parking lease agreement; council and staff recommended the lease be recorded so the obligation appears in the chain of title for the parking lot serving the 315 Locust property.
One council member noted the developer asked for a quicker release because the letter of credit was limiting his ability to use credit for a hotel project. Staff said the draft parking lease could be recorded quickly and reiterated that the borough first notified the developer about the requirement in October 2023.
The motion, made by Councilperson Giese and seconded by Councilperson Kaufman, authorized release of the letter of credit conditioned on proof of recording. Council acted by voice vote and approved the release with that contingency.
