The Andalusia City Council on Sept. 23, 2025, adopted two resolutions to complete the canvass of a municipal runoff: it certified Joe Nicks as the winner in District 1 and, after declaring a 183-183 tie in the District 4 race, held a roll-call vote that the council recorded as Presley Boswell receiving the majority of votes cast.
City Attorney Mark Christiansen told the council the canvass is a “ministerial task” — “It’s not discretionary. You just look and see what the numbers are and then certify them,” he said — and reviewed the statutory fallback if a governing body cannot break a tie: the code provides that a tie left unresolved by the municipal governing body must be decided by lot by the judge.
The council also considered one provisional ballot. A representative of the Board of Registrars reported the board had reviewed the case, consulted the secretary of state’s attorney, and unanimously decided not to count the ballot, saying the voter, identified in the record as Shannon Bridal, “was not registered in the district in which he voted.” That provisional ballot therefore did not affect the tie in District 4.
Councilmembers voted to approve Resolution 2025-33, which certified that Joe Nicks received the majority of votes in District 1 and declared a tie in District 4 to be decided by the governing body. The motion to adopt that resolution was moved and seconded on the record; the vote recorded five ayes and one abstention (Presley Boswell).
The council then read Resolution 25-34, directed a roll-call vote to resolve the District 4 tie, and the clerk called each member by name. The roll call recorded votes for Presley Boswell from Mayor Johnson, Joe Nicks, Councilman Mount, Councilmember Griffin and Councilmember Powell; Boswell abstained. The council filled the resolution to state that Presley Boswell received the majority of the votes cast and adopted it.
No further public evidence or provisional ballots were counted. After adopting the resolutions the mayor adjourned the special meeting.
The actions taken complete the council’s official canvass for the Sept. 23, 2025, municipal election for Districts 1 and 4, per the municipal code procedures described by the city attorney.
