LAFCO staff briefs commissioners on bills including SB 707; thresholds for applicability to special districts debated

LAFCO staff provided a legislative update on Sept. 17 covering three bills tracked by the commission — SB 777, SB 5 and SB 707 — and outlined how SB 707’s provisions on Brown Act eligibility could apply to some local agencies.
Rob summarized that the bills are awaiting the governor’s action and highlighted SB 707, which was discussed in relation to Brown Act applicability. Rob said the published eligibility language in the most recent draft includes population and organizational thresholds for applicability to city councils, county boards of supervisors and special districts. He said the only special district that likely meets SB 707’s criteria in San Mateo County at the moment is SamTrans, but commissioners asked for clarification of the numerical thresholds.
Commissioner Speer corrected one numerical point in the presentation, saying the relevant population figure for a city located in a county is 200,000 (not 600,000 as Rob initially stated) and asked staff to confirm the final version. Rob said he would double-check the statutory thresholds and return with confirmation.
The commission took no formal action on the legislative items; staff said they will continue to monitor the bills and report back as the governor acts or as statute language becomes final.
