Germantown revises code to allow limited front-yard and roadside sump-pump discharges

Public works staff said the existing language made many common configurations — notably sump pumps discharging to the front of a property or to roadside ditches — technically noncompliant. The proposed amendment allows sump pump discharge to the front of a property or to a roadside ditch under specified conditions, while preserving prohibitions on discharges directly into the roadway right of way. The revision also removes an ambiguous definition of the word “nuisance” that the village attorney said had been interpreted narrowly and created enforcement confusion.
At the meeting trustee discussion focused on practical compliance and enforcement implications. Staff said that when a sump pump is installed the plumbing permit process typically provides inspection; the amended code will allow the village to bring many existing properties into compliance without forcing reconfiguration of long-standing discharge patterns.
Committee members noted public-safety concerns from sump pumps discharging into gutters — winter ice formation and summer moss/algal growth — and said the ordinance will give the village clearer authority to address problem sites. The highway department will respond to flagrant conditions; enforcement typically begins with property-owner notification, staff said.
The committee moved the ordinance and adopted it by unanimous vote.
