Commission moves Rycon construction and Charles Pointe negotiations into executive session ahead of developer deadline

The Harrison County Commission voted on Oct. 1 to go into executive session to discuss a potential settlement with Rycon Construction and to consider status updates related to Charles Pointe negotiations and outstanding lawsuits.

County counsel and staff advised the board that Rycon had indicated a deadline of Oct. 15 to resolve outstanding issues or the company would withdraw from its proposal. After questions from commissioners, the county attorney said a document was in recommended form and that he was prepared to answer lingering questions and finalize the matter subject to satisfying the commission's questions. The commission made a motion to enter executive session to discuss matters "pursuant to 6 9 a 4 b 9" and later voted to take the Rycon matter up in a closed session that included named staff (Trey Zimmerman and Laura Peace) and select administrators.

The commission also removed agenda item 2 (status update of Charles Pointe negotiations and lawsuits) from the table and voted to take that matter into executive session for discussion of active litigation under attorney-client privilege; no public action on those matters was taken during open session and the minutes note that there was no action taken on item 2 at that time.
