The City of Color Planning and Zoning Commission on Aug. 26 recommended that the city amend its future land use plan for approximately 33.68 acres proposed as part of the Preserve at Keller Oaks planned development, changing the designation from mixed-use/medium and low-density single-family to high-density single-family.
Planning staff said the amendment would align the future land use designation with the developer's plan development (PD) submittal. Staff explained that the proposed "high-density single-family" category corresponds to lot sizes between 8,000 and 14,999 square feet. The commission was told that 59 notices were mailed to property owners within a 300-foot buffer and that a FLUP amendment is not subject to the same super-majority protest rules that apply to rezonings.
Commissioners discussed the timing and policymaking implications of amending the future land use plan at the same time as a rezoning/PD request. Several members said they preferred updating the plan of record at the time of a rezoning so that infrastructure planning (impact fees, roads, utilities) and other departments have a consistent reference. One commissioner noted that changing the zoning creates an entitlement that remains whether or not the current developer ultimately builds the project.
Commissioner Farner moved to recommend approval of the FLUP amendment; Commissioner Lyce seconded. The commission voted 6–1 to forward the amendment and the PD recommendation to the Sept. 2 city council meeting.
