Judge sets potential early termination date for Kiska Stewart, requests complainant contact

Judge Stephanie Boyd reviewed a defense request to terminate community supervision early for Kiska Stewart (case 2024CR012991W) and set conditions for an expedited review.
Defense counsel said Stewart has completed multiple requirements, including community service, a Batterer Intervention Program (BIP), and a donation to an advocacy project; counsel asked the court to consider early termination because Stewart is pursuing cosmetology school and needs to meet an open-enrollment deadline. The prosecutor opposed early termination based on the offense and length of supervision to date.
Judge Boyd said she would "strongly consider" terminating Stewart in December so that the termination would coincide with one year on supervision; however, she told the parties that if proof can be provided that Stewart’s renewal/enrollment deadline closes Dec. 1, the court would consider terminating probation in November. The judge directed the state to contact the complainant so the court could confirm there were no objections. The court set a recall for November 17 and instructed probation to submit a report confirming there were no violations; Stewart would not need to appear in court on that date if there are no violations and notice to the complainant has been completed.
The judge outlined specific conditions that would bar early termination: any positive non-prescribed UA, any new charges while on supervision, violations of no-contact or injurious-contact orders, or any other reported infractions.
Probation will submit a compliance/status report in advance of the November date; the court said the termination would be signed automatically if no violations were reported and complainant outreach had occurred by the deadline.
