The Special Magistrate, City of Oviedo, found Riverside Landing Landings INV LLC in violation in case CE25-000421 for failure to maintain the pond serving the plaza at 1801 Broadway Street.
City staff member Alina Acevedo presented the city's packet of evidence, including the notice of violation dated June 24, photographs, certified-mail receipts and affidavits of posting. Cameron Caicedo, Environmental Technician for Public Works, testified that the pond bottom and outfall were covered with vegetation and sediment, that follow-up inspections on June 16 and August 18 showed no improvement, and that the pond drains the plaza and borders Lockwood Boulevard.
The magistrate found the respondent not in compliance and ordered corrective action: clean the pond bottom and clear the outfall pipe and mitered end sections of sediment and vegetation. The magistrate set a compliance deadline of Oct. 23 at 5 p.m. and announced fines would begin to accrue if the property remained noncompliant. The magistrate first stated fines would accrue at "$125 a day" and later, after discussion of flood risk, said "we'll accrue at the rate of a $150 a day."
