The board granted a dismissal for case 25-88045 (219 Lewis Circle) after city staff reported the roof and property were in compliance. The board continued two matters that are in receivership — case 25-88132 (Spike Holdings LLC, 880 W. Marion Ave.) and case 25-88005 (925 W. Marion/960 W. Olympia LLC) — to the Nov. 26 meeting to allow staff to serve receivers and follow notice timelines.
For 1623 Red Wing Court (case 25-88346), staff reported an unpermitted dumpster and tall grass exceeding 12 inches on July inspections; the board found the city had established a prima facie case, ordered the respondents to remove or permit the dumpster and mow/maintain the yard within 30 days, and assessed $28.82 in case costs. The board warned failure to comply could result in fines up to $250 per day plus interest.
In case 25-88418 (450 Bell Harbor Blvd), staff reported outside storage and unlicensed vehicles on the driveway. The board found the city had established a case, noted that outside storage had been removed but unlicensed vehicles remained, and ordered compliance within 30 days and payment of $28.82 in case costs, with potential fines up to $250 per day for failure to comply.
Board and staff members discussed administrative issues raised by repeated cases tied to out-of-jurisdiction LLC owners and multiple receiverships; staff told the board that notice timelines and changing receivers complicate enforcement and that city council is pursuing options including foreclosure in some long-running cases. Staff also said the training and procedure about whether a prima facie finding is required for penalty hearings will be reviewed with the city attorney and updated if necessary.
The board also heard staff updates about ongoing code matters citywide (including a former hotel site and other properties where staff are coordinating with the city manager and public works) and set its next meeting for Oct. 21, 2025. Several cases were placed on the Nov. 26 docket to allow staff to complete notice to receivers where applicable.
