Council authorizes city manager to complete due diligence and close on Shield property if state mineral rights are cleared

The City Council authorized the city manager to complete purchase of the property referred to in staff materials as the Shield property (Mitten Road, south of the Community Park), contingent on the State of Florida waiving its mineral rights, and authorized the manager to execute an extension of the option period if necessary.

Staff said the property’s due diligence has been completed and that the remaining item is the state waiving mineral rights for the site. City Attorney Carey and the property attorney are processing paperwork; staff reported the matter appears to be in the pipeline and unlikely to present legal impediments but could take additional time. The council approved a motion to permit the city manager to close on the property subject to the waiver and to execute an extension to the option period if processing extends past the deadline.

Councilmember Voltz moved to authorize the purchase and extension; Mr. Frampus seconded. The motion carried 7-0. Staff said recorded due diligence items were clean and that closing would proceed once the state paperwork is complete.
