Bell Vista developer seeks sidewalk and street-tree waivers; neighbors petition and letter-of-credit cash-out pending

Planning staff briefed the commission on a reopening request for the Bell Vista primary plat (Phase 3) to exclude previously required sidewalks and street trees. Staff said the developer notified the county it was unwilling to increase the existing security (a letter of credit) to install sidewalks; as a result planning staff said they plan to cash the developer's letter of credit on or before Oct. 27, 2025 if the developer does not provide the funds or otherwise resolve the matter.

Staff said the right-of-way is already accepted into the county inventory and that if commissioners approve the sidewalk and tree waivers at the next regular meeting, the developer would not be required to record a secondary plat and could receive the funds back. Planning staff said they had collected a petition/exhibit from many of the Phase 3 homeowners opposing the sidewalks and were accepting it as a consent letter for the waiver request (exhibit 5 in staff materials).

Neighbors have raised concerns about pedestrian safety and the physical constraints of drainage ditches and variable topography. Staff noted Section 2 of the subdivision contains an easement for sidewalks if and when sidewalks are installed in the future, and that Section 1 of the subdivision predated the later sidewalk standards. Staff said the petition included most affected homeowners, and they will follow up to verify any missing signatures before the next hearing.

No formal vote was taken at the administrative meeting; staff said the item is scheduled for the upcoming regular meeting (the next planning commission meeting) where the sidewalk and street-tree waiver requests and the reopening of the primary plat would be considered.
