The Delaware-Muncie Metropolitan Board of Zoning Appeals took action Sept. 24 on a large group of applications. Below are the board’s formal actions and key conditions; staff will issue certification for each approved case so applicants can proceed to permitting.
- VZA29-25 (Division/variances for two houses at 1238 S. Burlington Drive and 1201 S. Tennessee Ave.): Approved with condition that proposed parking on Lot 25B be installed if approved by the city engineer and that the planning process be completed and recorded. Vote: 5 yes, 0 no, 1 recusal.
- BZA38-25 (division of house from accessory garage at 3007/3009 E. Jackson St.): Approved; certification to follow. Condition: garage use restricted to personal use only. Vote: 6 yes, 0 no.
- BZA40-25 (variance to operate a small tattoo studio out of accessory structure at 4612 S. Hoyt Ave.): Approved. Conditions include applicant to obtain required health and building permits; approval limited to applicant. Vote: 6 yes, 0 no.
- BZA41-25 (replace a mobile home on pier supports at 8304 E. DeSoto St.): Approved; building commissioner supports with no safety concerns. Vote: 6 yes, 0 no.
- BZA42-25 (increased pole‑barn height at 1224 E. 20th St. for RV storage): Approved for personal storage only; business use prohibited. Vote: 6 yes, 0 no.
- BZA43–46-25 (four separate setback variances for multiple City View/Muncie City View Homes properties on South Elm Street and South High Street): The board consolidated discussion and approved each variance; approvals reference prior BZA certifications and maintain prior conditions. Vote tallies varied but each passed (majorities recorded per roll calls during meeting).
- BZA47-25 (replacement barn at 601 S. Sycamore St., Gaston): Approved to replace a storm-damaged barn; building commissioner supported request. Vote: 6 yes, 0 no.
- BZA48-25 (new McDonald’s at SE corner of Macedonia Ave and 20th Street): Approved with hardship stated; staff noted future access points must be confirmed with the city engineer and INDOT coordination on access. Vote: 6 yes, 0 no.
Many of these approvals included the common condition that a variance or special-use approval be limited to the current applicant and that required building, fire and health permits be obtained and passed before operations commence.
Why it matters: The slate of approvals affects property owners across Muncie and Delaware County — from small home-based uses to new commercial development and multiple infill residential variances. Staff will issue certifications and monitor compliance with conditions.
